McGrath Law Firm PA has just filed suit against e-Cig manufacturer (Shenzhen Kanger Technology Co., Ltd. in China) and store. On January 20, 2016, Matthew Gilson purchased an e-cig from Smoker’s Haven in Laconia, NH. The e-cig exploded while in Gilson’s pocket at work, causing extensive burns to his leg. The damage has resulted in multiple surgeries and a lengthy stay in the hospital. The explosion was caught on video tape at Mr. Gilson’s place of employment.
The lawsuit allegations are product liability – negligence as to the manufacturing defect and injury from negligent sale of a defective product with breach of the implied warranty of merchantability as to Smoker’s Haven.
