Fungal Meningitis outbreak exposure continues to grow

McGrath Law Firm, spearheaded by former federal prosecutor, Peter G. McGrath, is seeking to pierce the corporate veil and attach the personal assets of NECC’s officers in a lawsuit pending in Middlesex Superior Court in Massachusetts.
The CDC reports that 317 cases of Meningitis have been reports, resulting in 24 deaths over 17 states, due to tainted steroid shots manufactured by New England Compounding Center (NECC) and distributed to various facilities across the country.Click http://www.fda.gov/downloads/Drugs/DrugSafety/FungalMeningitis/UCM325467.pdf to see a list of NECC’s customers. On October 6, NECC announced a voluntary recall of all its products currently in circulation that were compounded at and distributed from its Framingham, Massachusetts facility.

The CDC and FDA have confirmed the presence of a fungus known as Exserohilum rostratumin unopened medication vials of preservative-free methylprednisolone acetate (80mg/ml) from two of the three implicated lots from NECC (Lot #06292012@26, BUD12/26/2012 and Lot #08102012@51, BUD 2/6/2013).  The laboratory confirmation further links steroid injections from these lots from NECC to the multistate outbreak of fungal meningitis and joint infections.  Testing on the third implicated lot of methylprednisolone acetate and other NECC injectable medications continues.

As of October 22, 2012, a total of 54 patients have CDC laboratory-confirmed fungal meningitis. This form of fungal meningitis is not contagious. CDC’s laboratory has confirmed Exserohilum rostratum in clinical specimens for all but two patients of these patients.  Of the other two patients, one has been found to be infected with Aspergillus fumigatus  and one with Cladosporium. These fungi are common in the environment but were not a recognized cause of meningitis prior to this outbreak.

The CDC reports that 20 people have died as a result of the tainted steroid shots provided by New England Compounding Center (NECC), 257 people affected in 16 states.  CDC and state health departments estimate that approximately 14,000 patients may have received injections with medication from three implicated lots of methylprednisolone and nearly 97% of these patients have been contacted for further follow-up.

Meningitis outbreak death count due to tainted steroid shots rise to 19, patients affected in 15 states

The CDC has reported that the meningitis outbreak has affected 247 people to date in 15 states, with 19 dead.  Tennessee has seen the largest outbreak of the states affected, with 61 affected people and 8 deaths.
On October 15th, McGrath Law Firm, spearheaded by former federal prosecutor, Peter McGrath, on behalf of an anonymous client who contracted fungal meningitis as a result of tainted steroid shots, filed a lawsuit against New England Compounding Center and principal officers (NECC), in the Middlesex Superior Court in Massachusetts.

McGrath Law Firm files 1st lawsuit in Massachusetts against NECC and owners

The lawsuit alleges that the facility exceeded its legal permit and distributed the tainted steroids without proper legal authorty.

McGrath Law Firm announces it has filed a lawsuit against New England Compounding Pharmacy, Inc., in Framingham, MA, for allegedly distributing a steroid medication tainted with bacteria.   The lawsuit also filed claims against the individual owners and operators of the facility.  The tainted steroid has caused meningitis in numerous patients nationwide.

The complaint requested an Attachment of the assets of the individuals who own and operate the facility.  Apparently one of the founders of the manufacturing company, Barry Cadden, has surrendered his pharmacy license.

–According to the complaint, John Doe was recently informed that he contracted meningitis as a result of the distribution of medicine tainted with bacteria.  The Plaintiff  received steroid injections at a pain clinic in New Hampshire.

There are no quality control requirements to protect patients from receiving tainted steroid injection.  Meningitis is a horrible condition and there is no excuse for a patient having to face that risk unnecessarily.

A patient who received steroid injections after May 21, 2012, should contact legal counsel to protect his or her legal rights.
