McGrath Law Firm files 1st lawsuit in Massachusetts against NECC and owners

The lawsuit alleges that the facility exceeded its legal permit and distributed the tainted steroids without proper legal authorty.

McGrath Law Firm announces it has filed a lawsuit against New England Compounding Pharmacy, Inc., in Framingham, MA, for allegedly distributing a steroid medication tainted with bacteria.   The lawsuit also filed claims against the individual owners and operators of the facility.  The tainted steroid has caused meningitis in numerous patients nationwide.

The complaint requested an Attachment of the assets of the individuals who own and operate the facility.  Apparently one of the founders of the manufacturing company, Barry Cadden, has surrendered his pharmacy license.

–According to the complaint, John Doe was recently informed that he contracted meningitis as a result of the distribution of medicine tainted with bacteria.  The Plaintiff  received steroid injections at a pain clinic in New Hampshire.

There are no quality control requirements to protect patients from receiving tainted steroid injection.  Meningitis is a horrible condition and there is no excuse for a patient having to face that risk unnecessarily.

A patient who received steroid injections after May 21, 2012, should contact legal counsel to protect his or her legal rights.

All claims have not been adjudicated and any allegations made are unproven at this time.

Breaking news: 4 NH residents have contracted fungal meningitis from tainted steroid injections

Four more people from New Hampshire are among the unfortunate victims of the nationwide outbreak of fungal meningitis as a result of the steroids distributed by New England Compounding Center in Farmingham, MA. According to the CDC, there are now 15 deaths, 198 exposed over 13 states.
The CDC reports that as many as 14,000 patients had received the tainted steroid shots — an increase by 1,000 from earlier estimates. The new estimate includes patients who received steroid shots in knees, ankles and shoulders. Those patients, unlike the majority who received the spinal shots for back pain, are at risk for serious infections but not meningitis, the CDC said.

Aspergillus Meningitis outbreak update 14 dead, 170 cases. McGrath Law Firm to file lawsuit in Massachusetts

McGrath Law Firm has 2 clients affected by the New England Compounding Pharmacy, Inc. d/b/a New England Compounding Center (NECC).  McGrath Law Firm, spearheaded by Peter McGrath, former federal prosecutor, announces he plans on filing suit in Massachusetts in the near future.
The CDC is reporting 14 dead with 170 cases in 11 states.

In addition, the CDC reports the following on its website:

  • As of October 10, 2012, CDC’s fungal disease laboratory has confirmed the presence of the fungus Exserohilum in 10 people with meningitis and the fungus Aspergillus in one person with meningitis.
    • Clinicians should continue to contact patients who have received medicines associated with three lots of preservative-free methylprednisolone acetate (80mg/ml) from the New England Compounding Center (NECC) that were recalled on September 26, 2012. The potentially contaminated injections were given starting May 21, 2012. See updated Clinician Guidance webpage for more information.
    • CDC’s guidance to patients has not changed as a result of the expanded voluntary recall of all NECC products, announced October 6. Patients who feel ill and are concerned about whether they received a medication from one of the NECC products recalled on September 26 should contact their physician.
    • Patients need to remain vigilant for onset of symptoms because fungal infections can be slow to develop. Typically in this outbreak, symptoms have appeared 1 to 4 weeks following injection, but it’s important to know that longer and shorter periods of time between injection and onset of symptoms have been reported. Therefore, patients and physicians need to closely watch for symptoms for at least several months following the injection. For more information, see updated Patient Guidance.

McGrath Law Firm expands its legal action on Aspergillus Meningitis outbreak

McGrath Law Firm, spearheaded by former  federal prosecutor, Peter McGrath, is expanding legal action as the Aspergillus Meningitis outbreak continues to grow.
According to the CDC’s website, there are 119 cases in 10 States across the nation, resulting in 11 deaths as a result of the distrubution of three Lots* of Methylprednisolone Acetate (PF) Recalled from New England Compounding Center on September 26, 2012.  The lot numbers include Lot #05212012@68, BUD 11/17/2012; Lot #06292012@26, BUD 12/26/2012; Lot #08102012@51, BUD 2/6/2013 ** All vials of Methylprednisolone Acetate that were sent to Nevada were recalled prior to use.

Several clients have now called who have been tested.  Some are still waiting for results, and some have bee told they are negative for now, but it may turn up later.  Aspergillus Meningitis has a long incubation period.

All claims have not been adjudicated and any allegations made are unproven at this time.

McGrath Law Firm update information on meningitis outbreak/symptoms and faqs

We have gone to the CDC’s webpage and are providing this info to you.  If you believe you have been exposed to the Meningitis as a result of receiving a steroid injection, first call  your doctor for treatment and then call us to learn your legal rights!
McGrath Law Firm, PA is leading in the tainted steroid injection legal cases.  We already have clients that received the injections.  The steroid injections were prescribed for pain and tainted with Aspergillus, which can be deadly.  Even the testing is painful and full of risk.

The following info can be found on the CDC’s website, as well as a list of facilities who received the tainted steroids to provide to their patients.  As of this afternoon, the tally has doubled since Friday.  There are at least 91 patients, and 7 dead, with potentially hundreds more affected.

General Information:

Is the source of the outbreak known?
CDC is investigating medications and products that are associated with this outbreak of meningitis. At this point, there is not enough evidence to determine the original source of the outbreak, however there is a link to an injectable steroid medication.  The lots of medication that were given to patients have been recalled by the manufacturer.

What are the states that received the implicated product?
California, Connecticut, Florida, Georgia, Idaho, Illinois, Indiana, Maryland, Michigan, Minnesota, North Carolina, New Hampshire, New Jersey, Nevada, New York, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Virginia, Texas, and West Virginia

What is meningitis?
Meningitis refers to inflammation of the protective membranes covering the brain and spinal cord known as the meninges. The inflammation is usually caused by an infection frequently with a bacteria or virus, but meningitis can also be caused by less common pathogens such as fungi. The severity of illness and the treatment for meningitis differ depending on the cause. Thus, it is important to know the specific cause of meningitis.

What is fungal meningitis?
Fungal meningitis occurs when the protective membranes that cover the brain and spinal cord are infected with a fungus.  Fungal meningitis can develop after a fungus spreads through the bloodstream from somewhere else in the body, as a result of the fungus being introduced directly into the central nervous system, or by direct extension from an infected body site next to the central nervous system.

Is fungal meningitis common after epidural injections?
Epidural injections are generally very safe procedures, and complications are rare.  Fungal meningitis is an extremely rare cause of meningitis overall, including after epidural injections. The type of epidural medication given to patients affected by this outbreak is not the same type of medication as that given to women during childbirth.

What are the symptoms of fungal meningitis?
Symptoms of fungal meningitis are similar to symptoms of other forms of meningitis, however they often appear more gradually and can be very mild at first.  In addition to typical meningitis symptoms, like headache, fever, nausea, and stiffness of the neck, people with fungal meningitis may also experience confusion, dizziness, and discomfort from bright lights. Patients might just have one or two of these symptoms.
