Hays Medical Center Hep C Outbreak said to affect hundreds in Hays, KS

July 26, 2012 By

Hays Medical Center in Hays, KS is notifying 500 people of Hepatitis C outbreak.
Due to the fact that David Kwiatkowski worked as a contract radiology technician in the HaysMed cardiac catheterization laboratory from May 24, 2010, to Sept. 22, 2010, HaysMed and KDHE are working together to notify all patients who were treated at the cardiac catheterization lab during this time and recommend they receive testing for hepatitis C. Only those patients who underwent cardiac catheterization procedures between May 24, 2010, and Sept. 22, 2010, at HaysMed were potentially put at risk.

Those patients who were potentially exposed at HaysMed are being contacted by mail with information on how to receive testing for hepatitis C through KDHE. However, McGrath Law Firm, PA will request an independent testing location be put in place.

The Emporia Gazette has reported that according to State Epidemiologist Charles Hunt, hepatitis C is a virus that is passed through blood and affects the liver. Approximately 2,000 confirmed cases are reported in Kansas each year. Only about one in five persons who become infected with hepatitis C virus initially becomes ill, with symptoms ranging from a mild illness to more severe disease. Most persons with hepatitis C virus develop a chronic infection, which is a serious disease that can cause long-term health problems. There is no vaccine against hepatitis C virus. For additional information on hepatitis C, visit the U.S. Centers for Disease Control and Prevention website at http://www.cdc.gov/hepatitis/C/index.htm.

McGrath Law Firm is a full-service law firm with offices in New Hampshire and South Carolina, and has affiliations with law firms in Kansas and nationwide.

Exeter Hospital Hepatits C defendant arrest is a good thing for Hepatitis C outbreak lawsuit against Exeter Hospital

July 26, 2012 By

As reported this past week, David M. Kwiatkowski, 32, a former Exeter Hospital technician who has hepatitis C, is charged with taking and abusing controlled substances using syringes that were then used in the treatment of patients at the hospital.
It’s one step closer to the end, although it’s only one step in a marathon. Because federal prosecutors are involved, the criminal case should move more quickly toward resolution. The criminal case will also help him with the civil litigation by providing him with a plethora of information he will use in representing his clients.  Federal prosecutors do a lot of our work for us.

The Hepatitis C class action lawsuit filed against Exeter Hospital in Exeter, NH alleges negligent supervision on the part of Exeter Hospital and involves roughly 30 people who still do not know whether they have hepatitis C and another 30 or 40 who do not have the virus but are still suffering.  Note, with the recent developments, we expect these numbers to rapidly grow.

Even those who tested negative are enduring a lot of pain and suffering.

Exeter Hospital has until August 7, 2012, to answer the Hep C class action lawsuit filed in June and a hearing will likely take place in Rockingham Superior Court sometime in September.

NH Health Officials Schedule Public Meeting on additional testing due to Exeter Hospital hep c outbreak in Exeter, NH

July 26, 2012 By

The Union Leader has reported that NH State health officials will be hosting a public meeting in Exeter on Thursday for anyone with questions related to the hepatitis C outbreak at Exeter Hospital.
The Department of Health and Human Services said the meeting will be held at 6 p.m. at Exeter High School.

Health officials said they will be on-hand to answer questions and provide details of testing clinics that will be set up at the high school.

This week, the department expanded its guidelines of who should be tested for hepatitis C to include patients treated in the hospital’s operating rooms and intensive care unit from April 1, 2011, to May 25, 2012.

By late Wednesday afternoon, Exeter Hospital was estimating that it would actually only be around 3,400 people in need of testing.

State officials say they expanded testing to include those who had surgery at the hospital or were admitted to the hospital’s intensive care unit from April 1, 2011 to May 25, 2012, because Kwiatkowski had limited access to those areas during those times.
